Any individual who enters, attempts to enter or in any way participates or attempts to participate in any games, contest, sweepstakes or giveaway (“Contest”) conducted by Forex Cargo Inc. (“Forex”) (each such individual is hereinafter referred to as a “Participant”) agrees to be bound by the terms and conditions provided in these Official General Contest Rules (“General Rules”), as well as by Forex’s interpretations of these General Rules which are final and binding in all matters relating to any Contest. Some Contests will have specific rules developed for them (“Specific Contest Rules”).

In the event there is a discrepancy or inconsistency between these General Rules and the Specific Contest Rules, the Specific Contest Rules shall control.

NO PURCHASE NECESSARY:

Unless otherwise noted, no purchase is necessary to enter or win a prize. A purchase will also not improve your chances of winning.

APPLICABLE LAW (VOID WHERE PROHIBITED):

All Contests are subject to and governed by applicable federal, state and local laws and regulations. Participation in this Contest/Games is void where prohibited or otherwise restricted by law.

ELIGIBILITY:

The contest is open to all participants of the FPAC Event and must at least be 18 years old. Employees of Forex and other companies associated with the promotion of the Contest, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies and well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Contest is subject to the Terms and Conditions set by Forex specifically for the FPAC event.

AGREEMENT TO OFFICIAL RULES:

Participation in the Contest constitutes entrants full and unconditional agreement to and acceptance of these Official Rules and the decisions of Forex, which are final and binding. Winning a prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein. 

CONTEST PERIOD:

The contest is valid for One (1) day ONLY. Contest runs from opening to closing of the FPAC Event (October 14, 2017)

WINNER NOTIFICATION:

All winners will be notified
a.) personally, during the course of the FPAC Event,
b.) through Forex’s Facebook page and Twitter within 24 hours
c.) through email notification
d.) through SMS notification

PAST PRIZE WINNERS:

Participants may only win and participate on this Contest ONCE, unless specified by Forex and upon the discretion of its Management. Prizes are final and NON-TRANSFERABLE.

ENTRIES ARE THE SOLE AND EXCLUSIVE PROPERTY OF FOREX:

All Contest entries and/or related submissions become the sole and exclusive property of Forex upon transmission. Contest entries will not be returned and may be used by any Contest Entity for any purpose whatsoever related to any Contest, without additional compensation to the participant or any other individual or entity.

DISCLAIMER OF RESPONSIBILITY FOR ENTRIES:

Forex is not responsible for problems with Contest entries, including but not limited to, entries which are lost, late, misdirected, damaged, incomplete, illegible, or cannot be completed due to electronic or technical difficulties, even if the problem is the result of the sole or partial negligence of Forex.

FALSE FRAUDULENT OR DECEPTIVE ENTRIES OR ACTS:

Participants who, in the view of Forex, provide false, fraudulent or deceptive entries or who engage in false, fraudulent or deceptive acts in connection with the Contest will be disqualified and subject to criminal prosecution.

WINNER SELECTION:

Prize winners will be selected per the criteria announced for the Contest. If the Contest requires Participants to answer trivia, provide information or otherwise perform in some manner to participate and qualify to win, the decisions of Forex will be final as to all matters including the accuracy and/or completeness of the answer, as well as the quality of the information. If a winner is unable to be notified for any reason for any amount of time, the applicable prize may be forfeited and awarded to an alternate winner.

HOW TO CLAIM PRIZE:

Prize is subject to availability. The Participant prize-winner will be notified by the specified deadline date of the contest by phone, email, SMS, and Social Media accounts of Forex. Process in claiming of prizes will be stated in the email/SMS that will be sent to the winner. Prizes may also be claimed after the participation of games, contest or drawing. 

PRIZE FORFEITURE:

Unless otherwise stated, winners shall have thirty (30) days from the date of selection to claim the prize. Failure to claim or pick up prize within this time for any reason will result in forfeiture of the prize. Forex reserves the right, in its sole discretion, to award unclaimed prizes to alternate contestants or not to award the unclaimed prizes.

ADDITIONAL COSTS:

Any costs relating to the prizes are the sole responsibility of the winner.

PUBLICITY RELEASE:

Unless prohibited by applicable law, Participant authorizes and irrevocably grants to Forex and the other Released Parties (as defined above) permission to, from time to time, reference and discuss Participant and their participation in the Contest in publications and/or on their website(s) in photographs, video recordings, digital images, audio recordings, as well as in newsletters, news releases, other printed materials, and in materials made available on the Internet or in other media now known or hereafter developed for any purpose Forex and/or the Released Parties deem proper. Such reference and discussion may involve Participant’s name and voice, and other personal/biographical material or their participation on-air.

DISQUALIFICATION:

All participants agree to be bound by these General Rules. Non-compliance with any of these General Rules will result in disqualification and all privileges as a Participant will be immediately terminated. Forex, in its sole discretion, further reserves the right to disqualify any person for: (i) tampering with the entry process or the operation of the Contest; (ii) gaining an unfair advantage in participating in the Contest; (iii) obtaining winner status using false, fraudulent or deceptive means; or (iv) engaging in otherwise unsportsmanlike, disruptive, annoying, harassing, or threatening behavior.

GENERAL CONDITIONS:

In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Contest is unable to run as planned for any other reason, as determined by Sponsor in its sole discretion, the Sponsor may, in its sole discretion, either (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Contest and, in the event of termination, award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the the game or undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages (including attorney’s fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision. 

RELEASE AND LIMITATIONS OF LIABILITY:

By participating in the contest, entrants agree to release and hold harmless the Sponsor, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with Forex, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the Related Parties) from and against any claim or cause of action arising out of participation in the contest or receipt or use of the prize  including but not limited to: (a) any technical errors associated with the Contest, (b) unauthorized human intervention in the Contest; (c) any other errors or problems in connection with the Contest, including, without limitation, errors that may occur in the administration of the Contest, the announcement of the winner, the cancellation or postponement of the event and/or the flyover, if applicable or in any contest-related materials; or (d) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Contest or acceptance, receipt or misuse of the prize. Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the contest, and in no event shall the entrant be entitled to receive attorney’s fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Entrant waves the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

DISPUTES EXCEPT WHERE PROHIBITED:

Each entrant agrees that any, and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by said parties. 

Privacy Information collected from the entrants is subject to Forex’s Privacy Policy.
